Legal Question in Family Law in California

Me and my two brothers own a house together. The oldest constantly makes it impossible to peacefully live in the house by slaming doors, yelling at the tv, yelling at his kids, yelling at his dog, swearing, playing loud music, and other types of what i think it's called "passive agressive behavior". Can I 'audio-record' this behavior without his knowledge or consent and legally use it in a court of law to get him evicted and possibly sue for harrasment, discrimination, and threats?

It is a felony to record someone else without their knowledge and consent.
