Legal Question in Family Law in California

Child custody for sole parent

My live in boyfiend and father of my son hasn't taken care of our basic needs for about 1 year . He is a alchoholic and pot smoker. If that wasn't bad enough he has 8 14 ft. plants of marajuana in our backyard. He refused to remove them so I left to Arizona to stay with family becase I have no family there. What are my legal rights to keep my son here?

Contact an Arizona attorney. Discuss the possibility of raising necessity as a justification for the move without court order or permission. Contact the DA in the county in which you were living and lay out the reason for leaving him. File an action in Arizona as soon as possible. Then obtain a court order for custody as soon as possible. The responses to your questions are based on your statement of the facts. Only by discussing the matter with an attorney can you be in the best position to make a decision on the best approach this situation.

I would suggest that you retain a California attorney to deal with the custody issues. I think that he can give you good practical advice. I wouldn't delay because at this time he could get a motion to require you to return the child to California. Good Luck, Pat McCrary

Jurisdiction in California will be established after a 6 month residency. Until then, if he files in Arizona, he may have you called back to AZ. Best to arrive at a stipulation regarding these critical issues. Call me directly at 16192223504
