I am a victim of domestic violence emotional/physical and verbal abuse even when I was pregnant. It got worst when I had the baby. He had tried to abandon me and baby over 3 times during the first week of baby's birth. He was not financially supporting my baby. I pay the bills, rent, baby's needs, etc. There were only a few times he gave some amount only when I ask him. It was not enough. Because of these I asked him to leave but he threathened me and he will take my baby. However, my friend convinced him to leave. But he was stalking. even went to the City to file for TRO but later on changed my mind. I think I have also developed a trauma whenever he gets mad. I wanted to move from LA to SF. Can he file something against me if I move with my baby? I am scared if I would file for child custody/support and the court will order to give him the right to have my baby even for a few days a month. What should I do?

I agree with the prior answer. However if you are in a situation where you can not afford an attorney you need to contact a women's organization such as WEAVE and let them know what you are going through. There are also family law faciliation offices in most court houses and they can assist you with filing the documents on your own if you have to. Whatever you do, don't do nothing the situation will only get worse.

File immediately and take the upper hand. Don't wait for him to do something. Please don't be afraid to take the initiative. With the right attorney, you can take custody of your child and move to where ever you want to move. I would seek advice of counsel if I were you.
