Legal Question in Family Law in California

Custody Change of 17 Year Old

The mother of my spouse's minor child wants to move and not take the child with her. Child will be 18 in April, but has not graduated from high school. She was enrolled in a continuation school near our home as well as a beauty college which she starts next month. Don't know when she will graduate high school, but beauty school is about 13 months. Does custody and support cover this (and for how long) and will a change order be necessary?

Re: Custody Change of 17 Year Old

If your husband's daughter wishes to come to live with you, then I would suggest that you immediately ask the court to modify custody and support to reflect who she is living with and to change child support payments from your spouse to the mother to a situation where the mother is paying child support to your spouse. File immediately as generally, the court only makes such orders retroactive to the date of filing. Keep in mind child support continues until the child turns 18 or when she graduates from high school, whichever is later.

Hope this helps.
