Legal Question in Family Law in California

custody schedule for summer

My ex and I split the summer schedule for our daughter. The agreement also says that either one of us can take up to two weeks vacation with our daughter per year. Right now, my ex and I want one of the same weeks. I want it so she can participate in a competition. He wants it to take her to Boston. He has contacted his lawyer about it. Can he just take whatever two weeks he wants every summer? How can I change this? I want a set schedule for summer, one week on, one week off, however it works. Thanks.

Re: custody schedule for summer

What you should have had in your order (or look and see if you do) is language that says, "either party may take up to two weeks vacation with the child during summer break. Each party shall give 30 (# you think is necessary) days advance written notice. In the event of a conflict, in odd years Mom has priority, in even years Dad has priority.

Got it?
