my daughter's mom is illegal, if she were deported would my daughter be able to stay? What are my custody rights as the father?

I assume your daughter is a U.S. citizen. If so, she has the right to stay here, of course, if she were an adult. However, since she's a minor, the mom could take her with her. If you do not want that, you would need to file a Petition for Custody and Support of Minor Children with the court and request legal and physical custody of your daughter, or come to an agreement with the mom about leaving the girl here with you.
