Legal Question in Family Law in California

Divorce hold up

I am a widow, how has been seeing a man who is legally separated from his wife and has dependent children. He has filed for divorce, but at the 11th hour, she has changed the terms of child support, stating that even if he gets custody of the kids, he must continue paying her child support. Is this legal? second question...Is there anything that can be done to sever the marriage and deal with custody issues later? This and similar issues have been holding up the divorce for over 2 years.... Thanks for your guidance

Reply: Divorce hold up

In a general sense, your friend can file a motion to bifurcate, which will allow him to become restored to the status of a single person before the rest of the divorce proceeding is completed.

For a specific opinion regarding his individual circumstances, I suggest that he consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
