Legal Question in Family Law in California

Was injuring about what legal action could be brought against a now 22 year old that supposedly 10 years ago at age 13 touched his brother sexually who was 5 at the time, no injury, no penetration, just touching. If they go to counseling now what would happen to the 22 year old? The ex husband of the mother involved is threatening the 22 year old telling him "he's going to jail etc. and must leave". What is the legal ramification today?

Probably no law enforcement authority would chose to get involved. If they did, what proof would they have? What does "touching sexually" mean as between a 13 year old and his 5 year old brother? Who needs counseling? Is the once 5 year old now claiming harm? I see no issue here other than a very nasty ex-husband needlessly harassing the 22 year old.
