Legal seperation

Do you have to divide assets for a Legal seperation?

I have been married 16 years, we have 3 children and we own a house. I want a divorce but he won't leave and the house is in his name.

You can not force him out of the house unless he has been violent with you or threatened you with violence.

The court will deal with community property whether he wants to stay or not. You do not necessarily have to divide community property if just separation, however. Call to discuss. Don Holben 800-685-6950
