Legal Question in Family Law in California

I am married and i lived in California all of my life and i just moved to kansas with my son. I am married and my husbend is in the Army and lives in North carolina. Did I break any laws or can you give me any advice? I just got a call from a co worker from California today saying that a man called about serving me divorice papers..The reason I moved is becouse my husbend cheated on me and got someone pregnant and i couldn't stand looking at her face...What should I do?

You are going to need a lawyer on this one, and if you read my past posts, I suggest ways for family law parties to do things themselves whenever possible. If your husband has established his station in NC as his residence and has been there six months or more, he may be able to force you to do the divorce there. If he has kept California as his residence he can make you do the divorce there. You only would have broken laws if you had been served before you moved. So you are OK on that issue, but you are going to need help from a lawyer in dealing with the jurisdictional issues and hopefully getting the case handled in the Kansas courts. I suggest you find a Kansas attorney for starters, and if they need to consult with a California family law attorney, feel free to have them give me a call.
