Legal Question in Family Law in California

I owe child support, due to an accident and not working I fell really behind, about 40k. I have a lawsuit about to settle and expect 50-55k... My question will they just take the 40K I have no problem giving them 30k right now then use the rest to get my life in order. Will they know if we settle out of court? Again I will pay some of this, but I was out of work 18 months and would like to get everything in order so I can PAY on a regular monthly schedule.

That is possible under a compromise for arrears that the child support agency will accept compromised amounts, especially if you can pay a lump sum they will be very happy to take it. I would be careful if they file a lien though on that settlement amount so the money never even gets to your bank account.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
