Legal Question in Family Law in California

Am I responsible for spouses Credit card debt

Under California law am I responsible for my spouses Credit card debt if he dies.

I just discovered my husband has incured a lot of credit card debt without my knowledge. I am not a signatory on any of his accounts. Is there any way to protect myself from this debt he has incured.

Re: Am I responsible for spouses Credit card debt

Here, the burden of proof is on the creditors at issue to show this was a community debt and not a separate property debt, especially since you do not appear on any of their credit card contracts, and these accounts may have been opened before you were married. Of course we would need more details on all of this to properly advise you of, or defend your rights efficiently and effectively.
