Legal Question in Family Law in California

What do I have t o do legally to give custody of my daughter to my aunt?

My daughter's father and I were never married but he signed the birth certificate. He has not contacted me personally for about 4 years...does he have any legal rights to my daughter? I just filed custody papers in Or to give custody of my daughter to my aunt because I am joinging the Air Force and cannot go in as a single parent. I do not want the father to be involved in her life because he was convicted of a sex offense shortly after I left him.

You should file a petition for guardianship of your daughter. Request that you aunt be appointed as her guardian. Although father has not had contact with her since birth he has parental rights. The fact that he has been convicted of a sex offense should greatly reduce the possibility of him obtaining either custody or visitation.
