Legal Question in Family Law in California

My soon to be ex wife and her atty are trying to claim $25K in Epstein credits to wipe out my portion of $22K in equity in our property. She is claiming that we were seperated in May 2009. She did not file for legal separation and I have been living in the house and have contributed to all the bills. Can she do this?

That is a trial issue. You need to fight the date of separation and maybe go to trial on the separation date. Once you determine that you will need to start doing tracing of your bank account to show what you contributed to. A consultation with an attorney will be useful since it seems rather complicated at this point.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
