Legal Question in Civil Litigation in California

Is Hertz Corp. responsible for replacing my cell phone if I have proof via gps tracking that one of their employees stole it? ( I have been working with them and they have already admitted to employee theft)

An employer is normally not liable for the criminal acts of its employees unless they are aware of prior such behavior or negligently allow the employee to do the criminal act. They do have a duty to demand that the employee return the cell phone. Probably if you apply enough pressure on them they will agree to compensate you.
