identity theft

a loan company approved a car loan in my name by someone who stole my identity. During the review of the loan application, there was an address discrepancie and middle name and birthdate on the application did not match my social security number. Do I have good cause to seek damages for negligence by the finance company?

Probably not. The criminal act of a third party is normally an intervening and superceding cause, that will relieve the finance company of a claim for negligence. You would have to show some other degree of fault to recover, in my opinion.
