Legal Question in Civil Litigation in California

Landlord's appliance damages the floor

Hi, we're leaving our rental property 1 month early, but we thought we had agreed with our landlords that we would pay the difference in the rent as if we were staying till the end of the lease. About a week ago, we noticed that the vinyl tile near the washer and dryer (landlord owned) was popping up. It appears that water has soaked into the floor under the tiles, without any visible signs of leaking or water. The washer and dryer work fine, they have only had normal use and we actually share the laundry with our roommate and the landlord (they live in a unit in the back of the property). The landlord appears very angry with us at leaving, and now wants us to fix the swelled part of the floor. Can they legitimately ask us to pay when we share the laundry with them, they are their appliances and we all were unaware that there was an appliance leak?

Re: Landlord's appliance damages the floor

The landlord can only charge for damages, other than normal wear and tear, caused by the tenant or the tenant's guests. Clearly that is not the case here.

Our landlord-tenant legal services provides legal rights notices to landlords on behalf of renters who are in your situation. If you would like us to put an end to his actions we can draft a notice letter to your landlord for $100. This includes unlimited phone consultation.

Yours truly,
