Legal Question in Civil Litigation in California

My mom lives in san jauquin, ca - my 52 year old brothers has moved back in 5 years ago and refuses to leave. Someone told her that since he gets his mail there he cannot be evicted and has a right to stay. He does not pay rent or anything but lay around all day and night. She has tried several times to leave but he refuses to leave saying this is his house. She is confused as what to do.

What your brother is doing probably constitutes elder financial and possibly emotional abuse. You should contact the Fresno County Adult Protective Services and have one of their social workers look into the case. If they believe action is warranted, they will facilitate having the District Attorney get involved in the case for you.
