Legal Question in Immigration Law in California

Hello

I have been selected at the DV lottery 2012. I'm under an H1B visa and I want to apply for an adjustment of status. My number is current in january. I told the KCC that I want to do an adjustment of status. Now

- How can my local USCIS know that I want to do an adjustment of status ? Do I need to wait until my number is current and to send all the I-485 petition to Chicago ?

- Which fees do I have to pay ? Because on the Department of State they talk about DV lottery fees $440 and Immigrant Visa Application Processing Fees $ 305 and on the USCIS they talk about $ 985

Thanks

You cannot adjust status until your rank number is current. Since the January 2012 Visa Bulletin has not come out yet, it is hard to say exactly when your rank would become current. It might be worth consulting with an immigration attorney before you file anything because if you lose out on getting your DV lottery green card because of a mistake, it can be more costly in the end.
