Legal Question in Insurance Law in California

what can I do?

I have just gotten into a car accident but did not relize at the time I had no insurance, I was not at fault, Im now out on disability leave from work and going to doc's almost every other day for my back. what am I able to get form this situation?

If you had no insurance, you fall under Prop. 213. You can only recover your medical bills and wage loss, in addition to the damage to your car and loss of use of your car. You are NOT entitled to pain and suffering.

You have 2 years to file suit against the other party for your injuries. The statute of limitation is longer for property damage. You can also attempt to recover for loss of income and substitute transportation, if any, and pain and suffering. Hope you feel better soon.
