Legal Question in Insurance Law in California

Wonder if I have a case

Last Friday on a referral from my doctor, I went to Physical Therapy and he broke my rib. I'm 80 yrs old on Medicare, do I have a case and if so, who do I sue? The doctor, the therapist or both?

I had a similar case in the past. I brought suit against the therapist and the clinic she worked for. We settled the case at mediation for close to $100,000.

Re: Wonder if I have a case

You certainly have a case against the therapist. The result suggests conduct below the applicable standard of care for a physical therapist. Value will depend on your course of healing.

Possibilities against the doctor seem less likely based on the information you've given.

You have a case against the therapist. The value would depend on your course of treatment for your injury.
