Legal Question in Intellectual Property in California

Use of photograph of me I let someone take.

In NY or CA, if someone took a picture of me (nude) that I willing posed for and is now distributing it, is there any legal action I can take against them? As far as I know its not being used for profit.

Generally, it would depend upon whether you gave express consent, usually in a form of a signed release for the use of your image. Just because you let someone take your picture does not necessarily mean you give them the right to distribute it or show it to others, whether or not they make a profit. You should discuss your situation with a competent litigation attorney who can advise you whether the facts of your case warrant a lawsuit.
