Award of Attorneys Fees
If a employer fires you, and you have a contract for 2 plus years remaining, with no release for them, and they withhold moneys owed to you.(as stated in the contract). If you then have to go to court to get your money is there a statute that awards you attorneys fees, and or can you demand them in the settlement?
Re: Award of Attorneys Fees
You can only get attorney fees if the contract allows for it.
Re: Award of Attorneys Fees
If the money being withheld by the employer is wages, you can get attorneys fees awarded under Labor Code Section 218.5, if you win.
