What date determines payment?

An employee quits, and the employer pays outside of the 72 hours code

limitation period. e.g. the employer mails the final check 14 days after the

date of quitting (postmarked) and the employee recieves the check 18 days

after the date of quitting. If the employee is entitled to waiting penalties for

up to thirty days, how long does the penalty period toll: to the date of mailing

the check, or as of the date the employee receives the final check?

Take it to the labor commissioner and let him/her determine that issue.
