Legal Question in Employment Law in California

Disability Insurance

What are my chances to receive disability insurance if I got into a car accident 2 1/2 months after I resigned from my job? I resigned because of re-occuring medical issues. What or should I have been paying into an unemployment fund/disability because I was un-employed?

Thanks in advance.

p.s I received a notice saying because I withdrew from the labor mrkt prior to the date I became disabled, I was not suffering a loss of wages but a loss of profit. Section 140.5 of the California Unemployment Insurance Codes.

Re: Disability Insurance

You will have to back up your claim with medical records. You must be able to document when you became disabled. If you think you can prove you were unable to perform the essential functions of your job while you were employed, appeal the denial of benefits. The time limit to appeal is very short so don't put this off.
