Legal Question in Employment Law in California

While I'm still on maternity leave, my boss called and said my position was eliminated due to restructuring. The firm offered a small severance package. They sent me the separation agreement. I signed and sent back and did receive the check (I have not cashed the check). What my boss did to me was wrong and violated my rights. It's a pregnancy discrimination. Now I changed my mind and want to send the check back to the company and contact a lawyer to go with the lawsuit, can I do that?

You may have had a case, but you waived it when you signed the agreement. You don't get a 'do over'. Cash the check.
