non compete agreements

If I signed a non compete agreement when I started a company, then left on my own to work for a competitor (who was my previous employer) can I be sued?

Technically, I will be a contractor payrolled through an agency, but onsite at the competitor, (have email and phone number of competitor).

The non-compete provision is enforceable only to a limited degree in CA, but it could prevent you from doing some things. You need to consult with an experienced attorney about the actual facts and circumstances involved in order to get an actual opinion and advice on what you can and should do to avoid getting involved in a lawsuit. With a few exceptions, non-compete agreements are not enforceable in California. You will need to have an attorney review the agreement for a more definitive opinion.
