Termination pay

I was terminated due to a personality conflict, I was given a snapshot of what compensation is due. I called to follow up and was told I would not be payed my commission until the homes I sold have closed. Can they hold my final check?

Re: Termination pay

An employer may delay payment of commission until it is earned. When a commission is earned is dependent on your agreement with your employer. The agreement must be fair, however, if the agreement requires the homes you sold to "have closed" to earn the commission that may be lawful. You should review your agreement with an experienced employment attorney to determine your rights.
