Legal Question in Employment Law in California

Work Suspension

My husband has been suspended from work with no pay. They are investigating him and will not tell him for what. When he is called in to be questioned do we have a legal right for him to request that I go with him. Can we request that we be allowed to tape record the inerview? Thank you!

Re: Work Suspension

no; yes. He can ask for anything, but there is no 'right' to either. If he believes the firing is 'illegal' [discrimination, retaliation] he should hire counsel to advise and handle this. He should not admit to anything. Feel free to contact me if interested in getting counsel.

Re: Work Suspension

You can make the request but there is no definate legal right for an employee not covered by a collective bargaining agreement to have a representative present. You should only tape record the meeting with the permission of the other party. Secretly tape recording the meeting could be illegal in certain circumstances.
