Legal Question in Medical Malpractice in California

Dental malpractice

My dentist performed an non-consented root canal on my underaged son and he has been in pain ever since. How do I proceed?

I would also like to find out the statute of limitations re this topic.

Thanks!

Re: Dental malpractice

If you have an opinion from another dental expert that there was malpractice/negligence by the operating dentist resulting in some kind of compensable damages, then you can consider filing a malpractice claim. The Statute of Limitations is normally a year for adults, but "Actions by a minor shall be commenced within three years from the date of the alleged wrongful act."

If you think you can get the required expert opinion, and if you're serious about pursuing this, feel free to contact me.
