Legal Question in Medical Malpractice in California

can you sue a cosmetic surgeon?

Hello,

I am trying to find out if I can recover money from two rhinoplasty procedures I underwent for asthetic reasons.

I had 2 surgeries performed by the same surgeon. The first surgery yielded absolutely no result. My own mother even didn't notice any change. I underwent a second operation, and still there was minimal result.

I have just undergone a third (and final) operation by a different surgeon who corrected what he said ''he has never seen before''. This surgeon has been in practice for over 30yrs, and the previous on e for about 5. I have had to spend 20k on this, and do not wish to go to trial, only to settle. I want the first surgeon to at the very least, pay for my surgery with the different doctor.

Re: can you sue a cosmetic surgeon?

Yes you can sue if you are able to show that the first doctor did something that was negligent or what is called "below the standard of care". This means not did you get a bad result, but the reason you got the bad result was due to doctor error. Also, your legal claim must be filed within one year from the time you knew or should have known that the doctor did something wrong.
