Legal Question in Personal Injury in California

I have been denied employment twice in the past 2 months because I have a non injury hit and run conviction. Date 05/31/2007, 3 year probation. How or can I hide this from future searches. It comes off my driving record next Aug.

Assuming you are not a minor, the conviction will remain on your criminal record. I doubt that you can get it removed. It coming off your driving record next August I presume means that your car insurance rate is no longer effected. Go to a criminal defense attorney to see what can be done; the discussion of what the lawyer can do, cost, etc., should be part of the free interview. Ask your probation officer.

If you think your prospective employer will run a criminal check, you have to tell them in advance of the conviction and try to explain it away [perhaps promise to take public transportation to work and back].

Sealing and destroying arrest records is my specialty. There is no such statute applicable to convictions. You could gt the conviction vacated and dismissed when you have successfully completed probation under Penal Code Section 1203.4, but that seals nothing. It just authorizes you to deny the conviction. If they do a background search, the arrest, conviction, vacating conviction and dismissal under 1203.4 will all appear, so it does you no good.

What I tell my clients when they report repeated losses of the "good jobs" or being repeatedly terminated when they find out about a conviction, is to explore self employment. Even then, if your career choice requires a professional license, they will know of the conviction as well.

Sorry I do not have better news for you. You are stuck with this conviction.
