Legal Question in Personal Injury in California

I don't know what the situation is, but my brother is arrested for hitting somebody's head with a hammer. That person had to get stitches in the hospital. Now he's filing a lawsuit against him. He called home twice but did not say much, and the police won't let us see him. I'm confuse and I don't know what to do. Please give me guidance.

If the police are holding your brother then the case against him is criminal, not civil. (There may also be a civil case, but chances are that none has been filed yet. Even if one has, the criminal case should be his top priority.) He needs a criminal defense attorney ASAP. If he can't afford to hire one, the court will appoint one to represent him at public expense.

Your brother will probably be much better off with private counsel if he can get one. Public defenders are generally good lawyers but they are overworked and can't give each case as much time as they should. Private lawyers can be more thorough, though such thoroughness comes at a price.

I agree with Mr. Hoffman. Though the Public Defenders are generally good lawyers, they have very heavy caseloads and cannot give each case the attention that most private attorneys can give.
