Legal Question in Personal Injury in California

my ex fiancee posted nude photos of me a website he created with his friends. the website is for posting photos of women and humiliating them. this happened june 2009 and the website was down for a year. the website is now up and running and im sure he reposted the photos but i am not able to see them due to you having to either post enough blogs to have access to see..... or you have to make a donation. i want to sue. no ifs ands or buts about it. i have money to do so. i want to know if i can and how do i go about doing this? also, in the past i have asked for them to be taken down and the next day i was on the front page of the website. i dont have the documentation... i have some chats between myself and my ex but he will not admit he posted them.

You can sue your ex, but pursuing the website would be harder. A restraining order might be a better bet, since it is more likely to get results and will probably be quicker. You are free to do both, but that will be more expensive. Unless your ex can afford to pay a large judgment, you may want to rethink your eagerness to spend money on lawyers.

You should be successful in suing for invasion of privacy, etc. The first thing you probably need is a demand letter from an attorney to your ex and the web site demanding that the photos be taken down, all be destroyed with verification to you, a stipulation of agreeing to a temporary injunction s if they appear again anywhere, permanent free access for you to check periodically that they have not been reposted, perhaps even some nude and demeaning photos of him that you are allowed to use if your photos are reposted, etc. Does he have any money that you could get via a judgment? Since he was the only one who had access to the photos, he either negligently or intentionally must have posted them or allowed someone else to post them.

To do the above, an attorney would charge you by the hour; probably at $250-300 or more [I am semi retired so I charge at $125 and you might be able to find other retired attorneys in your area that have discounted rates]. If a suit were filed because it appeared you could collect some money, you might still have to pay at an hourly rate unless you can show you could actually collect on the judgment. If possible, you might want to see if you can find other similarly mistreated women to join together so as to put more pressure on the site and the various ex's, as if the more honorable ones collapse it makes it easier to push the others to make amends.
