Since you had no insurance your claim for negligence would be limited to out of pock losses. These would include medical expenses, property damage and loss of earnings. However, since the other driver was involved in criminal activities a claim could be made for gross negligence or intentional tort which might not be so limited. Whether or not the other driver's insurance would coverthe loss. Lastly, if you were seriously injured, you can make a claim to the victims of crimes fund. forms for this can be obtained at police stations and district attorneys offices.

I suggest that you contact a competent lawyer in your area that is known for taking difficult injury cases and one that actually goes to trial.

You only receive damages for out of pocket type expenses, for example lost wages, medical expenses, when YOU do not have insurance.

I am however curious about one thing, why is it that you asked a question to Lawguru on 6/10/03 yet it was posted on 7/1/03? The gap seems to be unreasonably long. You need to timely file suit for your injuries and losses. If he had insurance, you should be able to recover a normal settlement or jury verdict and collect on it. His illegal conduct makes the case more valuable, usually. I'd be happy to discuss the facts and case with you. Contact me if interested.

If you know the identity of the other racer, even if he didn't hit you, he can be sued as well. The police report should list him if known. Contact me.
