Legal Question in Personal Injury in California

insurence injustist

I'm involed in a auto case that both insured partys

are with the same insurence company. I was not at

falt!The other party ran a stop sign. The problem is

the insurence company only wants to pay $2,800 and

with medical the total is over $30,000. The reason

that they state is in cases of this type thats all

they normaly pay. My lawer says when it goes to court

it would cost to much to fight and I would still end

up with nothing,small claims court does't even pay my

medical, I just don't understand how they can get away

with this.Is their any

Juries usually award less for soft tissue injuries than they do for broken bones. It is ridiculous since most of the time soft tissue injuries take more medical care to correct than broken bones. I would need to know the extent and type of injuries, damage done to the vehicles, the type of accident that occurred and additional information before I could give you my opinion on what you would get if this case went to trial. However, I do think you should consult with another attorney. I would think your current attorney is handling your case on a contingency basis. If so, he seems to be looking out for his best interests, not yours. The reason for this is he knows he will spend a lot more time if this case goes to trial than if you settle. Plus, he might be scared that he will loose a trial and not get any money. Believe it or not, most attorneys are afraid of going to trial.

There is a lot of information that I need in order to give you a second opinion. If you have very little damage to your vehicle, your damages are mainly soft tissue, you don't have any injuries that a picture can show of your injury(x-ray of broken bone, picture of injuries, MRI of disk injury, nerve conduction testing showing nerve damage and etc.) and your medical bills are mainly for physical therapy the insurance companies know that jurors don't like these kinds of cases when the insurance companies attorneys tell the jurors that the injured parties are not really hurt and they are just trying to defraud the insurance company out of money.
