Legal Question in Personal Injury in California

libel/defamation from hoa board member

I have a handwritten list, posted by a director of the hoa board where I live. It was posted to our community board. It falsely states Im selling drugs. It gives my name & address. How do I sue this director & do I need to sue the owners association also?

You would sue in small claims or Superior Court. You might want to sue the HOA depending on what capacity or how it was posted, what the board knew, etc.

As long as it is a lie, it is libel. You may contact me and I'll evaluate the case more thoroughly and we can potentially initiate a suit.

Re: libel/defamation from hoa board member

Absolutely. Further, this form of defamation of character would be deemed "libel" since it was in writing. Finally, since the libel falsely attacked your esteem in the community as an illegal purveyor of drugs, you have a VERY strong case against BOTH the HOA board and individual director, if anyone read and understood the false misrepresentations. Re: libel/defamation from hoa board member

It is unclear if you are on the board. If so, the statement may be privileged and then you will not have a case. However, if the statement is not privileged and it is not true, like the other lawyers have said, the statement is libelous.
