Legal Question in Personal Injury in California

i have a problem. i had a car accident and i wanted to ask for ur opinion. the other car was in the left lane and i was in the right lane. both lanes merge together. i was ahead of the other car about to merge. i was almost finished with merging when the other car stuck me from the left side of me vichele. the other car didnt stop or nothing. he continued to go straight and i dont know if he was paying attention or not. he was driving a ford goldline camper. i was driving a kia spectra. i just wanted to know whos fault was it? the ploice report indicates that they dont know who was at fault but my insurance is blaming me. the ploice report also says that the other driver of the car said that i was in front of him. he knew that the two lanes combine and i was at the end of my lane if i would have stopped i would have gotten on the side walk. i put my blinker on and indicated that i was going to merge into his lane. who's fault was it?

Mostly the other person's fault as they had the better opportunity to observe the situation.

Without seeing a diagram or a picture of the roadway it is somewhat difficult to tell. First question which lane merged out your or theirs? If you were the one changing lanes it would seem to be your fault if it was them then its theirs. Again I would need to see the roadway to give you a more definitive answer.
