Legal Question in Personal Injury in California

If I was ill and went to stay with someone. While there I got sick and my lungs where affected due to black mold and had to be treated because owner refused to fix an on going 2 year problem can I Sue the owner. If so what type of case is it and how do I determine amount?

Well you can always sue, whether it has merit is another thing. Amount? Yeah what are the damages? You tell me! Did you go to the hospital and nearly die; are there tens of thousands in medical bills, did you lose a lung? If you don't have actual damages then this is a waste of time. If you do then can you get a doctor to testify the mold caused your illness, and a lab to determine it came from the house you say it did? Are you willing to pay for those experts? It can cost $10 to 20 thousand easily.

Type? This is a toxic tort case. I only take cases where the evidence is clear, like someone sprayed in the face with chlorine gas or people will pay for their experts.
