Legal Question in Real Estate Law in California

Our concrete walkway NOT on our property

We bought a little vacation home a

number of years ago.With the

economy, however, we have been

renting it out.

We just found out that our fence

(which the original owners put up),

our concrete walkway, and our front

wooden porch is on the neighbor's

property!!!

We plan to re-build the front porch

(thankfully it's wood and relatively

easy to do) and move the fence to

inside our property line, which will be

according the the new surveyor's

flags.

We don't want to jackhammer and

remove the concrete walkway.

Is there any law that says I ''must''

do this, or may I just say that gee,

it's on your side, we're giving it to

you, or you can have it, or ???

I know many times, renters who affix

a screen door to property must leave

the screen door when they move. I

was wondering if it may be the same

for a concrete walkway????
