Legal Question in Real Estate Law in California

What constitutes fraud committed by a lender/bank? If they persuaded or pressured us to say the home was owner occupied KNOWING this was a second home so they could make the loan more appealing. Also suggesting a 2nd be taken on current home to use as a down payment on the second home. Is that the same as predatory lending when they pressure you knowing that you can’t afford or it is not in your best interest? Do we have any legal recourse against the lender/bank??

So have you been to see a bankruptcy lawyer about getting your second home's mortgage rewritten, and your 2nd wiped out, and any foreclosure immediately stopped, in a Chapter 13?
