'' motorized scooter accident againts car''

A child of 13 years old was riden in a motorized scooter. The kid thought he could go throught the highway before the ligh change green to the car, but it couldn't that. A car in a second line/ three line went throught the highway and hit the kid with the his back left of the car and flew to the kid to the street.

Police says the kid made a 21650 Violation of the Vehicle Code.

How can I proof that the guilty isn't of the kid? What kind of evidences have I to collect?

you need to bring any witnesses you have that saw the accident to court.
