Legal Question in Traffic Law in California

Same violation same week

I was cited for the same traffic violation 2 days apart, when I recieved the second violation I was informed by the officer that I could not be cited for the same violation within a weeks period. When I went to the courts to clear the citation they explained that they had heard nothing of the sort and that the violation was still valid. Is this information true?

Re: Same violation same week

Thank you for your inquiry.

You actually can be cited upon a police belief that "probable cause" exists that you committed a particular crime. From there, it is the burden of the prosecutor to find you guilty beyond a reasonable doubt for each violation.

I hope this helps, but if you have other questions, want more information, or feel that you want legal representation, please feel free to email me directly at [email protected]. I'm happy to help in any way that I can.
