Legal Question in Wills and Trusts in California

If you are preparing a trust/will now (meaning 2010), are there any provisions that should be amended to reflect what the tax laws are now versus what they may be in 2011. Should certain provisions be left out all together, and amended in 2011 if need be?

I am not an expert in this area, but the common sense approach is to plan based upon the current tax programs as you have no assurance what will change later [except for prior enacrments that have phase out dates--but they might be renewed]. What might be good for 2011 might not for 2014. Put in everything you want to and then amend it when you know for sure that there will be a change, or list the possibilities by saving if X exists then..., but if Y then ....
