Probate regarding distribution of real estate

Q-1: Executor wants to put a lien against real property for reimbursement of attorney fees & executor fees. How can this be stopped or avoided? Other heirs are willing to pay their share of attorney fees and executor fees. Other heirs were never notified prior to letter of court date of 03/29/06.

Q-2: Executor agreed to purchase agreement for her share of property value and has now reniged on signing agreement and on even selling her share. Legal documents were prepared and presented to executor. Can executor be forced to sell since verbal agreement was made and purchase agreement was legally prepared and submitted to executor?

You may be able to petition the court regarding all of these issues, or for removal of the executor. A complete review of the court file and all documents, including correspondence to and from the executor, is necessary to provide a correct and complete answer.
