Legal Question in Workers Comp in California

AME report, is it final ?

Hi, I've been on disability for 1 year. The AME just sent out his report saying that this is not an industrial injury but because of my previous job injury in 1996(settled down with no payment to me)and because of the minor car accident 2 years ago. My lawyer does not agree with that report but does not want to tell me what he will do. The AME put me in P&S. I am sufferring with neck, bilateral shoulder, elbows, wrist pain due to using computer and I need to get back to TTD. The carrier attoney asked me to go back to work so did my lawyer. They don't seem to understand the terrible pain I'm having. Pls let me know the legal way to get back to TTD or once the AME have decided, that would be the end of my case ?

I would recommend that you have your attorney cross examine the AME in order to find out how he formed his conclusions etc.

I agree with Mr. Lupoff regarding the cross examination of the AME. In some instances AME change their mind or admit that they have overlooked something or have made a mistake.
