Legal Question in Workers Comp in California

Can Employer force an Early Return To Work?

My PTP has stated that I can only type for 2 hrs/day. My employer's ''Early Return to Work'' prgm states that I must go back to work in a new position, which they have found for me. I'll be a greeter at our hospital, showing pt's to their appt's. I'm in disagreement w/ my PTP assessment. My WC adjuster is allowing me to see a specialist. What are my legal rights? Do I have to go back to work in this (undesirable) position? Can they bully me in this way? Do I need an attorney?

Re: Can Employer force an Early Return To Work?

You may change your PTP if you reasonably disagree with your doctor's diagnosis for early release. You are entitled to change your doctors. Some employers and their insurance companies have medical provider's network (MPN) and you may choose another doctor within the network. To get an unbiased diagnosis, I highly recommend an Agreed Medical examination by AME otherwise insurance company doctor's opinion tend to be very biased against you. Please contact my office at 213.388.7070 to discuss your case further.
