Legal Question in Workers Comp in California

Psychological consult

I consulted with a psychologist assigned by the insurance company who affirmed that issues behind my emotional distress claim as a result of my immediate supervisor's actions were warranted. I'm using my sick/vacation time since I'm still off. Will I recover these back? I'm a Los Angeles county employee. Should I seek the help of a lawyer.

Re: Psychological consult

You need to apply either for worker's compensation benefits or for EDD benefits. You need to be certified by a doctor to be able to receive these benefits. I highly recommend you to contact an experienced worker's compensation attorney to file a WCAB application on your behalf. Please call us at 213.388.7070 for a free consultation.

Re: Psychological consult

You should not be using your vacation time if you are off work due to a work-related injury. If your claim is denied, then you should go to the state and try to get disability. If your claim is accepted, then your employer should be paying you 2/3 of your weekly salary.

Please give me a call at 818.385.0520 for a free consultation.
