Re: Trip & fall

I would like to try and answer your question but it takes two parts.

1. Liability: The first issue is was the Chevron station or the owner of the land where the sidewalk is, if its different, liable for your falling? Are you partially at fault?

Assuming the Chevron owns the land and is obligated to maintain/service the sidewalk, then you must show that the sidewalk violated a standard or regulation and this violation caused your injury. Also, a tree root or underground growth may have caused the sidewalk to become unsettled. Any other possible cause which you have in mind? The owner of the tree could be on the hook.

In any case, your case would take some investigation to show negligence. Its the normal process to work a case up like your's to find answers to these questions.

2. Damages: Unquestionably you have a serious injury and one that is significantly compensable. Unfortunately, before you get any monye in compensation, you need to show that the landowner is at fault.

Please call me to discuss further. There is no charge for an initial consultation.
