Deadline to file mechanics lien?

Hello: On Nov. 21, 2006, we had the roof replaced on our single family home in Colorado. Payment was to be made when the work was satisfactorily completed.

However, the work was done very poorly. So we did not pay. Three other roofing companies inspected the roof and all advised us that the job needs to be redone. The roof also has failed the city building dept. inspection twice.

We have been trying for almost five months now to get the roofing company to do the job again properly. They have refused.

Last week I left a message for the owner of the company asking him to contact me. I heard nothing back from him until today when I received a ''Notice of Intent To File A Lien Statement'' from them.

I did some research and it looks like the roofing co. will not be able to file a lien on us because the deadline (2 or 4 months?)to file has passed. Am I reading this situation right.?

It is four months after their last work or materials furnished. If they last did work on November 21, 2006, it would appear that they have lost the right to file a lien.

Contact a construction attorney because if the lien is filed it can be removed at their cost with damages, possibly.
